This MCC has been filed for the following relief : “That, the hon’ble Court may kindly be pleased to allow the application and be pleased to further extended 90 days time to consider and decide the claim of the petitioner in respect of employment as per order dated 17/09/2024 passed by this Court in WP(S) No. 5860 of 2022.” 2. This Court vide it’s order dated 17/09/2024 disposed of WPS 5860 of 2022 with the following observation: “The only reason assigned by the respondents for rejecting the application of the petitioner for dependent appointment is ASHISH TIWARI Digitally signed by ASHISH TIWARI Date: 2025.03.27 10:22:56 +0530 that on 09.06.2020 he had crossed the age of 35 years. The petitioner has filed the mark sheet of class-IV, the PAN card and Adhar card indicating his date of birth. In the Service record maintained by the respondents the date of birth of the petitioner is not mentioned and only his age is mentioned. In the facts and circumstances of the case, the finding recorded by the respondents does not appear to be based on proper appreciation of the material on record. It is therefore, set aside. Petitioner is however directed to submit the relevant documents with regard to his date of birth before the respondents within a period of 30 days from the date of receipt of copy of this order and on that being done the respondents shall examine the date of birth of the petitioner and pass appropriate order within a further period of sixty days. Petition is thus disposed of.” 3. Learned counsel for the applicant submits that respondent would comply the order dated 17/09/2024 passed in W.P.(S). No. 5860 of 2022 within a period of 60 days from now. Therefore, the application may be allowed. 4. Not opposed by the other parties. 5. In view of the above, the respondents are granted further 60 days time to comply the order dated 17/09/2024 in W.P.(S) 5860 of 2022 from today. 6. M.C.C. disposed of.
