5. In the affidavit filed in support of the anticipatory bail application, it has been stated that the applicant is innocent and he has been falsely implicated in the present case. 6. A supplementary affidavit has been filed by the applicant disclosing his involvement in 13 other criminal cases, which are of similar nature. 7. The learned counsel for the applicant has submitted that co-accused Anwaruddin has filed an application under Section 528 B.N.S.S No. 757 of 2025 and this Court has stayed the proceedings against the aforesaid co-accused person by means of an interim order dated 15.07.2025, taking a view that the dispute was essentially of a civil nature. 8. The learned A.G.A. has opposed the anticipatory bail application and he has submitted that a charge-sheet has been submitted against two co- accused persons on 18.11.2024. 9.
Having considered the aforesaid facts and circumstances of the case and keeping in view the fact that the F.I.R averments make out non return of a part of amount invested by the complainant for lucrative returns though some amount has been repayed, which dispute essentially appears to be of a civil nature and that the proceedings of trial against co-accused Anwaruddin, have been stayed on the aforesaid ground, I am of the view that the aforesaid facts are sufficient for making out a case for granting anticipatory bail to the applicant. 10.
