Monomala, learned G.A. appearing for respondent Nos. 1, 2 & 3. None appeared for the private respondent Nos. 4 to 9, despite service of notice. At the outset, the learned counsel appearing for the petitioner submitted that as the member of the petitioner’s association are nearing their retirement age, they will be satisfied for the time being if the present writ petition is disposed of by directing respondent No. 3, the Project Director, Loktak Development Authority, Manipur, to consider the representation dated 22.08.2021 submitted by the General Secretary of the petitioner’s association on its own merit and strictly in terms of the LAIRENMAYUM INDRAJEET SINGH Digitally signed by LAIRENMAYUM INDRAJEET SINGH Date: 2025.05.07 16:36:12 +05'30' 2 applicable rules & guidelines and to dispose of the same by issuing appropriate order within a stipulated period. The learned counsel further submitted that at the time of considering the said representation, the authorities may be directed to take into account the order dated 31.05.2005 passed by the Gauhati High Court, Imphal Bench, in batches of writ petitions starting with WP(C) No. 501 of 2001. Mrs. L. Monomala, learned G.A. appearing for the respondents, fairly submitted that as the prayer made on behalf of the petitioner is confined to the consideration and disposal of the representation submitted by it, she has no objection in disposing of the present writ petition as prayed for by the learned counsel appearing for the petitioner. The learned G.A., also submitted that an observation may be made by this Court that this Court has not considered anything on merit while disposing of this writ petition. Taking into consideration the submission advanced by the learned counsel appearing for the parties, this Court is of the view that it will be in the interest of justice to dispose of the present writ petition with the following directions:- (i) The respondent No. 3, the Project Director, Loktak Development Authority, Manipur, is hereby directed to 3 consider the representation dated 22.08.2021 submitted by the General Secretary of the petitioner’s association on its own merits and strictly in terms of the applicable rules & guidelines and to dispose of the same by issuing appropriate order. It is also made clear that while considering the said representation, the authorities should keep in mind the order dated 31.05.2005 passed by the Gauhati High Court, Imphal Bench, in batches of writ petitions starting from WP(C) 501 of 2001. (ii) It is made clear that the whole process should be completed within a period of 3(three) months from the date of receipt of a certified copy of this order. (iii) It is made clear that this Court has not expressed anything on the merit of the present writ petition while passing this order. With the aforesaid direction the present writ petition is disposed of. JUDGE Indrajeet
