By means of this present C482 application, the applicants have challenged the entire proceedings of charge sheet dated 07.04.2023 and cognizance/summoning order dated 02.06.2023, passed by learned Judicial Magistrate/Civil Judge, Kichha, District Udham Singh Nagar in Criminal Case No.2192 of 2023, State of Uttarakhand Vs. Sukhveer Singh Begi and another, under Sections 420, 504, 506 r/w 34 of IPC registered at Police Station Pulbhatta, District Udham Singh Nagar, pending before the court of learned Additional Chief Judicial Magistrate/1st Additional Civil Judge (S.D.), Rudrapur, District Udham Singh Nagar. 5. Learned counsel for the applicants has limited his prayer to the extent that applicants may be permitted to surrender before the court concerned within fifteen days; however, their bail applications may be directed to be decided. 6. He also placed reliance upon the authority of Apex Court in the case of Satender Kumar Antil vs. Central Bureau of Investigation and another, reported in (2021) 10 SCC 773. For the sake of convenience, relevant portion thereof is quoted hereinbelow:- 3.Category A(e) Bail applications of such accused on appearance may be decided without the accused being taken in physical custody or by granting interim bail till the bail application is decided. 7. In such view of the matter, present C482 application is disposed-off permitting the applicants to surrender before the concerned court on or before 30.05.2025; if on surrender any bail applications are moved on their behalf, the court concerned is directed to decide the same in view of dictum of the Apex Court in the case of Satender Kumar Antil (supra). 8.
