Neutral Citation No. - 2025:AHC-LKO:14587 Court No. - 15 Case :- CRIMINAL MISC. ANTICIPATORY BAIL APPLICATION U/S 482 BNSS No. - 233 of 2025 Applicant :- Adarsh Singh @ Yeshu Singh Opposite Party :- State Of U.P. Thru. Addl. Chief Secy. Home Lko. Counsel for Applicant :- Sandeep Kumar Ojha,Dilip Kumar Verma Counsel for Opposite Party :- G.A. Hon'ble Shree Prakash Singh,J. Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record. The instant bail application has been filed on behalf of the applicant with the prayer to release him on anticipatory bail in Case Crime No. 219 of 2024, under sections- 2/3 of U.P. gangster and Anti-Social Activities(Prevention) Act, 1986 P.S.- Hathigawan District - Pratapgarh. It has been pointed out by learned A.G.A. appearing for the State the applicant has thirteen cases criminal history and further submits that the instant bail application is not maintainable as the applicant has not approached this Court while explaining the reasons that why he has directly approached this Court.
Learned counsel appearing for the applicant submits that there are ongoing strike in the district and thus, this bail application is maintainable. Considering the submissions of counsels for the parties, it transpires that the applicant has directly approached this Court. This Court has further noticed that though, it has been submitted by counsel for the applicant that there is strike in District Pratapgarh, but no specific date or time is given that since when the strike is running in district court. So far as the ratio of judgment of Ankit Bharti and others Vs. State of U.P. and another, 2020(3) ADJ 575 is concerned, it is clearly held in the aforesaid judgment that special reasons are to be given if, the accused/applicant is directly approaching this Court. Since, no special reason is given, thus, there is no force in the
arguments of learned counsel for the applicant.
Accordingly, the instant anticipatory bail application is dismissed on the ground of maintainability. However, it is provided that the applicant may approach the learned trial court if, he so desires. Consigned to records.
