The petitioner was arrested on 19.03.2024. He is in judicial custody. Charge sheet is filed for offences punishable under sections 363, 506 of Indian Penal Code, 1860 [IPC], sections 8 and 12 of the Protection of Children from Sexual Offences Act, 2012 [POCSO Act] and sections 3(1)(r), 3(1)(w), and 3(2)(va) of the - 3 - NC: 2025:KHC:6274 CRL.P No. 256 of 2025 Scheduled Castes and Scheduled Tribes [Prevention of Atrocities] Amendment Act, 2015. 3. Learned counsel for the petitioner has submitted that charges are framed on 07.12.2024 and the case is listed on 25.03.2025 for recording of the evidence. 4. In the light of the submission made by the learned counsel, petition is dismissed as withdrawn reserving liberty to the petitioner to file a bail petition before the Sessions Court, after completion of recording of the victim's evidence. Considering that the petitioner is in judicial custody since 19.03.2024, the learned Sessions Judge to make every endeavour to record the victim's evidence on the next date of hearing.
