Neutral Citation No. - 2025:AHC-LKO:14586 Court No. - 5 Case :- WRIT - A No. - 2643 of 2025 Petitioner :- Mohammad Nadeem Respondent :- Managing Director U.P. State Road Transport Corporation Lko And 4 Others Counsel for Petitioner :- Ganesh Kumar Gupta Counsel for Respondent :- Pradeep Kumar Shukla Hon'ble Abdul Moin,J. Heard. Under challenge is the suspension order dated 11.11.2024 as well as the charge sheet dated 13.11.2024, copies of which are annexures 1 & 12 respectively to the writ petition.
Learned counsel for the petitioner has argued on the facts as enumerated in the writ petition. It is settled proposition of law that the charge sheet can be challenged in some very rare and exceptional cases if it is found to be wholly without jurisdiction or for some other reason if it is wholly illegal. However, ordinarily the High Court should not interfere in such a matter. See:- Union of India and Anr Vs. Kunisetty Satyanaranana- (2006) 12 SCC 28.
Learned counsel for the petitioner has failed to indicate as to how the impugned charge sheet is without jurisdiction or for some other reason it is wholly illegal. Considering the aforesaid, no case for interference is made out. Accordingly, the writ petition is dismissed. However, it is expected that the competent authority shall finalize the inquiry proceedings expeditiously.
