However, none has put in appearance on its behalf, therefore, the said respondent is proceeded against ex-parte. The present application has been +led for condonation of delay in +ling the present appeal. It has been stated in the application that impugned judgment was passed by the learned District Judge dated 29.03.2025 and the copy was applied on 24.04.2025 and the same was delivered on 30.04.2025. Thereafter the legal opinion was sought so as to determine further course of action by the applicant. The matter was examined at various levels for the purpose of +ling of appeal and it was decided +nally to challenge the awards of the learned Courts below and in this process the delay has occurred in +ling the present appeal. The delay in +ling the appeal is neither intentional nor willful and the same has occurred due to unavoidable circumstances which were beyond the control of the applicant. Keeping in view the averments as made in the application which is supported by an a2davit and in view of the fact that the learned counsel for the applicant has no objection in case delay is condoned, the present application is allowed and the delay in +ling the present appeal is condoned.
