Neutral Citation No. - 2025:AHC-LKO:14476 Court No. - 6 Case :- WRIT - A No. - 2720 of 2025 Petitioner :- Pragya Maurya Respondent :- State Of U.P. Thru. Prin. Secy. Bal Vikas Evam Pustahar Lko. And 3 Others Counsel for Petitioner :- Anurag Dwivedi,Katyayan Mishra Counsel for Respondent :- C.S.C. Hon'ble Alok Mathur,J. 1. Heard Sri Katyayan Mishra, learned counsel for the petitioner and the Standing counsel on behalf of the respondents. 2. By means of the present writ petition the petitioner has sought a writ of mandamus to be issued to the opposite parties to accept the candidature of the petitioner on the post of Anganwadi Karyakartri through application dated 26.10.2024 filed by the petitioner. 3. It has been submitted that the respondents had issued a notification on 21.3.2023 seeking recruitment on the post of Anganwadi Karyakartri, Mini Anganwadi Karyakartri and Sahaika, against which the petitioner applied and considering that she was fully qualified and eligible for being appointed on the post of Anganwadi Karyakartri. It is stated that the petitioner has annexed all the documents and now she has come to know that her application is not being considered for appointment on the ground that the income certificate of her father has been wrongly obtained instead of her own income certificate. It has been argued on behalf of the petitioner that there is no infirmity in the application of the petitioner in as much as the petitioner is not gainfully employed and, therefore, does not have any income and in aforesaid circumstances she annexed the income certificate of her father. 4. Learned Standing counsel, on the other hand, has opposed the writ petition stating that even the writ petition is not maintainable at this stage in as much as the recruitment process is underway and only when the results are declared that it would be open to the petitioner to file a writ petition. 5. Considering the rival contentions, this Court notices that the recruitment process of Anganwadi Karyakartri, Mini Anganwadi Karyakartri and Sahaika is still under way and the candidature of the petitioner is before the authority concerned and merely because of certain information having been received by the petitioner regarding her candidature will not enable the petitioner to approach the Court seeking a direction regarding validity of her candidature. It is only when the petitioner is communicated with regard to her candidature that would enable her to to seek remedy against the respondents in case she is aggrieved by the same. We find that the matter is premature and when the petitioner receives formal communication regarding her candidature only then she can approach this Court. 6. In light of the above, the petition is dismissed at this stage. (Alok Mathur, J.) Order Date :- 10.3.2025 RKM.
