Learned counsel for the applicant, through this application, has prayed for expeditious disposal of the complaint case No. 1320 of 2023 "Krishna Magarn Vs. Salman Khan", filed under Section 138 of Negotiable Instrument Act, 1881, Police Station Kotwali Nagar, District Barabanki pending in the court of learned Additional Chief Judicial Magistrate, Court no.48, Barabanki. Learned counsel for the petitioner submits that the complaint has been filed in the year 2023. He further submits that although accused has been enlarged on bail, however trial has not commenced yet. He further argued that the proceedings under Section 138 NI Act are liable to be concluded within a period of six months as per Section 143 (3) of N.I. Act. In the interest of justice, learned counsel for the applicant requests that the proceedings be expedited. On due consideration to the argument advanced as well as perusal of the record, so also the provisions of 143(3) of N.I. Act, in the interest of justice, learned trial court is directed to make every endeavour to conclude and decide the proceedings of aforesaid case within a period of six months from the date of production of certified copy of this order.
