(Oral) Applicant Praveen Yadav is in judicial custody in FIR No. 187 of 2018, under Sections 302 and 201 IPC, Police Station Patel Nagar, Dehradun. He has sought his release on bail. 2. This is second bail application of the applicant. His first bail application has been dismissed in non-prosecution on 05.10.2020. 3. Heard learned counsel for the parties and perused the record. 4. The police found a dead body on 27.04.2018 near Rajeev Juyal Marg, Patel Nagar, Dehradun, based on which, the instant FIR has been lodged. 5. Learned amicus curiae would submit that the applicant is in custody since 2018; the case is based on the circumstantial evidence; till date, no witness has stated anything against the applicant; there are many witnesses, hence, it is a case fit for bail. 6. Learned State Counsel admits these facts. 2 7. Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail. 8. The bail application is allowed. 9. Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
