T. AMARNATH GOUD O R D E R 01.09.2025 [1] Heard learned counsel appearing for the respective parties. [2] This present writ petition is filed under Article 226 of the Constitution of India seeking the following reliefs: “(i) Issue Rule upon the Respondent to show cause as to why Writ in the nature of mandamus and/or Order/direction shall not be issued whereby directing the Respondents to consider introduction of Lower Bengali or similar named subject and curriculum as 3rd language for students of Class-V to Class-VIII of Holy Cross School, Agartala. (ii) Issue Rule upon the Respondent to show cause as to why Writ in the nature of mandamus and/or Order/direction shall not be issued whereby directing the Respondents to arrange for free of cost special coaching for Master Shrijit Deb on Lower Bengali or similar named subject and curriculum to makeover his lapsed study for Class-V & VI in suitable phases in terms of the Right of Children to Free and Compulsory Education Act, 2009. (iii) Issue Rule upon the School Respondents to show cause as to why Writ in the nature of mandamus and/or Order/direction shall not be issued whereby directing the Respondents to issue revised 'Progress Report Card' for Master Shrijit Deb of all Exams/ Tests pertaining to Lower Bengali or similar named subject and curriculum as 3rd language for his Class-V & VI after completion of special coaching in suitable phases. (iv) Passing an ad interim order directing the Respondents to allow the Petitioner's son, Master Shrijit Deb, to attend the Library during the Sanskrit period at Holy Cross School, Agartala, till disposal of the connected Writ Petition. (v) Passing an ad interim injunction order directing the Respondents to exempt the Petitioner's son, Shrijit Deb from sitting in Sanskrit Exam, till disposal of the connected Writ Petition. (vi) Make the rules absolute. (vii) Call for records. Page 3 of 3 (viii) Pass any further order/orders as this Hon'ble High Court considered fit and proper”. [3] After perusal of the record, it has been seen that the petitioner herein submitted representation dated 11.03.2025 in the form of email addressing the concerned respondent(s) and lastly on 15.03.2025, the petitioner sent another email addressed to the respondent Nos. 3 and 4, ventilating his grievances but all his attempts still pending with them. [4] Since the respondents have not decided the matter the present writ petition is filed. [5] In view of the pendency of the representations dated 11.03.2025 and 15.03.2025 before the respondents, without expressing any opinion on merits of the case, this present writ petition is disposed of directing the concerned respondent(s) to consider the representations within a period of one month from the date of receipt of the copy of this order and communicate the result to the petitioner. Since it is a policy matter, this Court is not inclined to interfere and pass any order on merits and this Court also feels that the ends of justice would be met if the concerned representations are decided by the respondents in accordance with law. [6] With the above observation and direction, this present writ petition stands disposed of. As a sequel, miscellaneous application(s), pending if any, shall stand closed. DR.
