Whether quashing of FIR in question would entail re- instatement of the petitioner, whose services were terminated by the respondents on account of registration of the FIR against him, wherein he remained in custody for more than 2 months and was a contractual employee at the time of registration of the FIR and executed Contract Agreement with the respondents-employer. Condition No.3, whereof, states ‘the service of FIRST PARTY will be purely on temporary basis. The appointment is liable to be terminated in case the performance/conduct of the contract appointee is not found good or if a regular incumbent is appointed/posted against the vacancy for which the first party was engaged on contract’.
Learned counsel on both sides seek time to address the matter. List on 24.07.2025.
