(Oral) By means of instant writ petition, the petitioner has sought the following reliefs:- “(i) To issue a writ and order or direction in the nature of mandamus to directing to the respondents allot the post to the petitioner. (ii) To pass any other suitable order or direction, which this Hon’ble Court may deem fit and proper under the facts and circumstances of the case.” 2. Heard learned counsel for the parties and perused the record. 3. It is a case of the petitioner that he responded to an advertisement issued by the respondent no.2 Railway Recruitment Board (“RRB”), Gorakhpur. The petitioner was successful in the written examination. He had undergone the 2 medical examination test also and the petitioner was declared successful, but he has not been allotted any post. 4. Counter affidavit has been filed by the respondents. 5. According to the petitioner, due to reasons recorded in medical report, the name of the petitioner could not figured in list of empanelled candidates for different safety categories of Junior Engineers. But, now additional/replacement panels for different categories of Junior Engineers, DMS & CMA have been issued by the RRB, Gorakhpur and in the panel prepared on 13.02.2025, the name of the petitioner is at Serial No.2. 6. Learned counsel for the petitioner would submit that the petitioner had cleared the examination conducted by the RRB, Gorakhpur, but he was not allotted the post for medical reasons. Hence, the petition. 7. Learned counsel for the respondents would submit that now the petitioner has further been called for allotment of the post and RRB has found that he is to be empanelled by communication dated 13.02.2025, which is Annexure 3 to the counter affidavit. 8. Learned counsel for the respondents would also submit that the process of posting of the petitioner would be completed within two months. 3 9. The Court takes on the record the statement given by learned counsel for the respondents. 10. In view of the statement given by learned counsel for the respondents, the writ petition is disposed of.
