(Oral) The applicant is in judicial custody in FIR No.194 of 2023, dated 25.08.2023, under Sections 29 r.w. 8/21 of the Narcotic Drugs and Psychotropic Substances Act, 1985, Police Station Gadarpur, District Udham Singh Nagar. He has sought his release on bail. 2. Heard learned counsel for the parties and perused the record. 3. According to the FIR, on 24.08.2023, 201 Grams Smack has been allegedly recovered from the possession of the Sarthak Sandhu, who revealed that he get Smack from the applicant. 4. Learned counsel for the applicant would submit that there is no evidence available against the applicant; the main accused, from whose possession Smack was recovered, has already been granted bail; the 2 applicant has been implicated merely on the statement of the co-accused. 5. These facts are admitted by the learned State counsel. It makes out the case for bail. 6. Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail. 7. The bail application is allowed. 8. Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount; to the satisfaction of the court concerned.
