Neutral Citation No. - 2025:AHC-LKO:13773 Court No. - 8 Case :- MATTERS UNDER ARTICLE 227 No. - 1172 of 2025 Petitioner :- Methodist Church Loni Ghaziabad Thru. Power Of Attorney Holder Yusuf Dass Respondent :- Board Of Revenue U.P. Lko. Thru. Its Member And 2 Others Counsel for Petitioner :- Rajesh Kumar Sharma,Parmanand Counsel for Respondent :- C.S.C. Hon'ble Jaspreet Singh,J. Heard learned counsel for the petitioner. Notice on behalf of respondent no.1 has been accepted by the office of learned Chief Standing Counsel. Since there is no nominated counsel for respondent no.2 and in view of the order proposed to be passed by the court, the court dispensed notice to respondent no.2 and 3. By means of the instant writ petition, the petitioner seeks expeditious disposal of his application for restoration. Having considered the material available on record including the instructions, a copy of which has been provided by the learned Standing Counsel which is taken on record indicates that the matter is listed on 21.3.2025 before the court. It appears that an application for recall of an order passed in the year 1998, has been filed. The grievance of the petitioner is that though the said application for recall is accompanied with an application under Section 5 of the Limitation Act but the notices have not been issued to the respondents. Considering the aforesaid, this Court without entering into the merits provide that in case if an application is moved by the petitioner for early hearing, at least the same be considered appropriately and if the notices have to be issued to the respondents, then the same may be done so that the matter can proceed. It is made clear that the court has not examined the case of parties on merits and the petition is being disposed of with the liberty as prayed for.
