All these petitions are arising out of orders passed by the learned Collector in respective writ petition holding the petitioners as disqualified under Section 10-1A or under Section 30-1A of the Maharashtra Maharashtra Gram Panchayat Act, 1958, i.e. Sarpanch/ Upasarpanch/Member is directly elected or elected by the member of the gram panchayat, respectively. 3. Admittedly, the elections, in these cases, have taken place in the month of December 2022. Now, the learned Advocate Mr. Salunke has produced on record copy of “Maharashtra Ordinance No. VI of 2023”. By way of said ordinance, time to submit caste validity certificate is extended by one year from the date of ordinance i.e. 13th April 2024. From reading of the said clause, it is clear that, even where the orders are passed, holding such persons as disqualified, still they are protected by this ordinance. Causes calling in sub-section (2) are the exceptions which reads as under: “(2) iksV&dye (1) P;k rjrqnh iq<hy ckcrhr ykxw vl.kkj ukghr& (d) iksV&dye (1) e/;s fofufnZ+ ्቗ dsysY;k tkxkaoj ;k v/;kns’kkP;k izkjaHkkP;k fnukadkiwohZ] iksV&fuoM.kqdk ?ks.;kr vkysY;k vlrhy( fdaok ([k) T;k lnL;kPkk oS/krk izek.ki=kpk vtZ] iMrkG.kh lferhdMwu Ethape ( 4 ) 928-930-936-939 QsVkG.;kr vkysyk vlsy.” 5. Thus, it is seen that, where already the elections have taken place pursuant to declaration of such disqualifications, are excluded and the cases where the caste validity certificate is refused by the committee, are the cases which are not covered by Sub-section (1) of Section 3. 6. As already observed that it is admitted position that in these cases, the elections have taken place in December 2022, this Court finds that cases are covered by the ordinance. 7. Petitions are, therefore, allowed only unless hit by Section 2 of the ordinance. 8. With this, writ petition stands disposed off. [KISHORE C. SANT, J.]
