In response to our order dated 10.03.2025, Sri Manish Mishra, learned Standing Counsel has instructions to inform the Court that physical possession of secured asset has not been handed over as yet by the borrower who was put to notice once again on 26.03.2025. 3. It appears that the S.D.M. concerned has not gone through our judgments dated 25.10.2024 passed in Writ C No. 8867 of 2024 (Bank of Baroda Vs. State of U.P. and 8 others) and 14.11.2024 passed in Writ C No. 9723 of 2024 (Pnb Housing Finance Ltd. Lko. Thru. Authorised Representative Mr. Surya Prakash Mishra vs. State of U.P. and others). Accordingly, we dispose of this petition with a direction to opposite party no.3 to ensure handing over of physical possession of the secured asset in terms of the order passed under Section 14 of the SAFARESI Act, 2002 on 05.12.2024 at the earliest unless there is any legal impediment in this regard. Sri Manish Mishra, learned Standing Counsel shall communicate our order to opposite party no.3 for doing the needful.
