The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Sections 366/376(1)/34 IPC, in connection with Sessions Trial No. 559 of 2023 arising out of Govindpur PS Case No. 16 of 2023. 3. Pursuant to the order dated 24.01.2025 status report has been received which indicates that the charge was framed on 28.08.2023 and out of ten charge-sheeted witnesses only seven have been examined and the petitioner is in custody since 13.02.2023. 4. Learned senior counsel contends that on the one hand only seven witnesses have been examined more particularly the victim is not turning up for examination and on the other hand there is no likelihood of early conclusion of the trial because for appearance of the victim NBW has been issued but still she has not been examined. 5. Learned APP opposed the prayer for bail. 6. Having regard to the aforesaid facts and circumstances of the case, since the victim is not yet examined and for that even NBW has been issued, there is no likelihood for early conclusion of the trial, the petitioner, 2 above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-III, Dhanbad in connection with Sessions Trial No. 559 of 2023 arising out of Govindpur PS Case No. 16 of 2023. 7. It is made clear that the petitioner shall appear on each and every date before the learned trial Court and he shall not threaten any witnesses and shall cooperate in trial. Further the petitioner will submit photocopy of his Aadhar Card and mobile number before the learned trial Court which he will always keep active and will not change and if any adverse report will come against this petitioner, learned trial Court shall be at liberty to cancel the bail of this petitioner.
