1. Heard Mr. R. Majumdar, learned counsel for the petitioner. Also heard Mr. R. Dubey, learned Standing Counsel for the State Election Commissioner, Assam.
2. The present writ petition is filed with a limited grievance that though the petitioner obtained a total 1561 votes and his nearest candidate obtained 1312 votes in the last Panchayat Election, for the post of Anchalik Panchayat Member of 2 No. Lakhipur under 18 No. Lalpani Gaon Panchayat of 3/3 No. Lakhimpur Dilkush Zilla Parishad, District Cachar, Assam, however, till date the election result has not been declared.
3. Mr. Dubey, learned Standing Counsel for the State Election Commission, Assam has produced a sheet disclosing declaration of result of all the Anchalik Panchayat Members in the district Cachar. The constituency from which the petitioner contested, is reflected at Serial No. 19 (18 No. Lalpani Gaon Panchayat of 3/3 No. Lakhimpur Dilkush Zilla Parishad), which goes to show that the name of the elected candidate is Rubina Wahid Laskar for Assam Gana Parishad.
4. In view of the aforesaid, Mr. Majumdar, learned counsel for the petitioner submits that this writ petition may be closed with a liberty to approach the appropriate Election Tribunal.

5. Accordingly, this writ petition stands closed. It is needless to say that the petitioner shall always be at liberty to approach before the appropriate Election Tribunal as per law, if he/she is aggrieved.
