Biswas, learned counsel for the petitioner. Also heard Mr. K. K. Das, learned Additional Public Prosecutor for the State of Assam. 2. This application has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, praying for grant of bail to the petitioner Rupak Das, who is facing trial in NDPS Case No.07/2022, pending in the Court of the learned Special Judge, Cachar, Silchar. Page No.# 2/2 3. The petitioner has defaulted in appearance and, therefore, he was remanded to custody. It has been submitted that the petitioner defaulted in appearance as he has gone out of station for some personal work, he informed his lawyer but his lawyer failed to take appropriate steps to that effect. 4. I have considered the submissions made by learned counsel for both the sides. 5. Considering the circumstances under which the petitioner has been remanded to custody, this Court is of the opinion the he deserves to be released immediately. 6. Therefore, the bail application of the petitioner is allowed. 7. The petitioner, Rupak Das, who is facing trial in NDPS Case No.07/2022, pending in the Court of the learned Special Judge, Cachar, Silchar shall be released on bail of Rs.25,000/- with one surety of like amount to the satisfaction of the learned Special Judge, Cachar, Silchar. 8. The petitioner is directed to regularly appear before the Trial Court on each and every date of hearing. 9. With the aforesaid direction, the bail application stands disposed of.
