Heard Mr. Jyotinjay Verma, learned counsel for petitioner, learned State Counsel for opposite parties no.1 to 14 while power on behalf of opposite party no.15 has been filed by Mr. Hari Om Pandey, Advocate which is taken on record. 2. Learned counsel for petitioner is granted liberty to implead the Regional Higher Education Officer, Varanasi, as opposite party no.16 during the course of day. Notice on behalf of newly impleaded opposite party has been accepted by learned State counsel. 3. Petition has been filed seeking a direction to concerned authority to appoint authorized Controller in the Shri Harsheshwarnath Sanskrit Mahavidyalaya, Brahman Patti, Bhiyanav, District Ambedkar Nagar and to take legal action in view of the enquiry report dated 01.01.2025 submitted by Regional Higher Education Officer, Varanasi. 4. Learned counsel for petitioner submits that on the basis of complaint made by petitioner, an enquiry was conducted and the aforesaid report dated 01.01.2025 was submitted by Regional Higher Education Officer, Varanasi recommending appointment of authorized Controller in the School. It is submitted that in pursuance thereof, the Joint Director of Education, Ayodhya Division also by means of letter dated 09.01.2025 alongwith a reminder dated 31.01.2025 directed the District Inspector of Schools to take action in accordance with the aforesaid report but nothing has been done till date. 5. Learned State counsel on the basis of instructions however submits that against the said report dated 01.01.2025, the opposite party no.15 , Management has submitted a representation before concerned authority seeking a review of the said report on the ground that it was an ex parte report. The said representation is yet said to be pending. 6. In view thereof, since the application by the School Management against the report dated 01.01.2025 is still pending consideration, the opposite party no.9 i.e. Joint Director of Education, Ayodhya Division, Ayodhya is directed to take a decision with regard to the said representation made by the Management expeditiously, preferably within a period of three weeks from the date certified copy of this order is submitted before the said authority, in case there is no legal impediment in accordance with law, after affording opportunity of hearing to all concerned including the Management. Consequential action shall be on the basis of fresh decision made by the said authority. 7. With the aforesaid, observation/direction, the petition stands disposed of.
