Neutral Citation No. - 2025:AHC:29880 Court No. - 5 Case :- WRIT - A No. - 6875 of 2018 Petitioner :- Mahesh Chandra Sharma Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Arvind Kumar Upadhyay,Rajesh Dutta Pandey,Sanjay Pathak Counsel for Respondent :- C.S.C.,Nagendra Nath Mishra Hon'ble Ajay Bhanot,J. Heard Shri Arvind Kumar Upadhyay, learned counsel for the petitioner, Shri Nityanand Mishra, learned counsel for the respondent nos. 2 and 3 and learned Standing Counsel for the State. The petitioner claims entitlement of regularization of his services on the post of Generator Operator. A representation in this regard has been made but to no avail. The only prayer made by learned counsel for the petitioner is that the representation of the petitioner may be decided within a stipulated period of time. Learned counsel for the respondent submits the matter requires factual determination as per applicable law by the competent authority in the first instance. However, he fairly contends that the claim of the petitioner for regularization is liable to be decided within a reasonable time frame. In wake of the preceding discussion and without going into the merits of the case, the authority concerned is directed to decide the representation of the petitioner regarding regularization of his services within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation. It is clarified that this Court has not gone into the merits of the controversy. The same shall be decided by the competent authority by independent application of mind. With the aforesaid direction, the writ petition is finally disposed of. Order Date :- 3.3.2025 Vandit Digitally signed by :- VANDIT AGRAWAL High Court of Judicature at Allahabad
