THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 9176 of 2020 ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…pleased to issue a writ, order or direction more particularly one in the nature of writ of Mandamus to declare the delay and inaction on the part of the respondents 1 and 2 in conducting further investigation in Crime No.60/2018 on the file of Women Police Station, Ongole, even in spite of the petitioner produces relevant documentary material which clearly establishes the commission of the offence by the accused u/s 304-B IPC as arbitrary, illegal and consequently direct the respondents 1 and 2 to conduct further investigation in Crime No.60/2018 on the file of the 1st respondent police station and file supplementary charge sheet in terms of section 173 (8) of Cr.P.C. in the interest of justice.…”
2. When the matter was taken up for hearing, learned counsel for the petitioner would submit that the petition may be disposed of, since the relief has become infructuous.
3. Learned Assistant Government Pleader for Home for the respondents is in attendance.
4. Recording the above said submission, the Writ Petition is dismissed as infructuous. There shall be no order as to costs.
