On 28.12.2023, the respondent no.2 published an e-tender notice for the construction of CC Road from Gram Sabha Jakh to Bhagetiya till Swargashram in Block Salt, District Almora. The tender of the petitioner was not accepted. The tender of the respondent no.5 was accepted and work was started. After some time, the petitioner came to know that the private respondent in collusion with the department was using mud from drain /water bodies instead of construction material in the construction of the said CC Road. The petitioner had submitted several complaints, but no action was taken. Therefore, the 2025:UHC:656 2 present writ petition has been filed under Article 226 of the Constitution of India with the following prayers :- “(I) Issue a writ, order and directions in nature of mandamus directing the respondents to conduct a proper and thorough investigation into the alleged irregularities in the construction of CC Road Jakh-Bhagetiya Connect Road, Block Salt, District Almora, by any independent investigation agency (II) Issue any other appropriate relief in facts and circumstances of the matter. (III) Award cost of the writ petition.” 2. Heard Mr. M.S. Pal, learned Senior Advocate assisted by Ms. Medha Pande, learned counsel for the petitioner and Mr. Suyash Pant, learned Standing Counsel for the respondent nos. 1 to 4. 3. Mr. Suyash Pant, Advocate, submitted on instructions that three member committee has been constituted on 17.01.2025 to inquire the present matter. 4. After the said submission, Mr. M.S. Pal, learned Senior Advocate, has requested to decide the present writ petition accordingly. 5.
