Revenue Deptt. Lko. And 3 Others Counsel for Petitioner :- Rakesh Kumar Singh,Anadi Kumar Singh Counsel for Respondent :- C.S.C.,Dilip Kumar Pandey Hon'ble Attau Rahman Masoodi,J. Hon'ble Subhash Vidyarthi,J.
1. Heard learned counsel for the petitioner and learned Additional Chief Standing Counsel for the State.
2. The present writ petition has been filed in public interest seeking a writ of mandamus directing the respondent nos. 2 and 3 to restrain the respondent no. 4 i.e. Gram Panchayat from making construction of the fair price shop.
3. The writ petition instituted by the petitioner in public interest is misconceived for the reason that by virtue of Article 243G of the Constitution of India, the State legislatures can give Panchayats the powers and authority they need to function as self-governing institutions. Schedule-11 appended to the Constitution of India has identified as many as 29 entries regarding which the laws are to be made by the State government for empowering the gram panchayats. Public Distribution System is one of them. The fair price shop in question is constructed in furtherance of the scheme of the State government and on the basis of resolution passed by the Land Management Committee based on the recommendation of the Lekhpal regarding its suitability. The construction is also informed to have been completed
4. In these circumstances, we decline to entertain the present writ petition and the same is hereby dismissed. ..
