[2025:RJ-JP:22374] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous 2nd Bail Application No. 4195/2025 Hariprasad Saini S/o Late Ramgopal Saini, Aged About 57 Years, R/o Ward No. 4, Near Saraswati Secondary School, Dungaram Ji Ki Dhani, Police Station Losal, District Sikar (Raj.) (Petitioner Is In Judicial Custody At Central Jail, Jaipur). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. P.L. Hissaria For Respondent(s) : Mr. Naresh Kumar Gupta, PP HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 28/05/2025 1. This second bail application has been filed under Section 483 of BNSS, on behalf of the petitioner, who has been arrested in connection with FIR No.09/2024 registered at Police Station Sadar Jaipur, District Jaipur (West) (Raj.) for the offences punishable under Sections 420, 406, 467, 468 & 120B of IPC. 2. The first bail application filed on behalf of the petitioner was dismissed as withdrawn by this court vide order dated 07.01.2025 while giving liberty to the petitioner to renew the prayer of bail after submission of result of investigation. Now, charge-sheet has been filed in this matter, thus this second bail application has been preferred. 3. From bare perusal of the record it appears that vide order dated 25.04.2025, on the request of learned counsel, interim bail [2025:RJ-JP:22374] (2 of 2) [CRLMB-4195/2025] was granted to the petitioner to settle the dispute amicably wherein petitioner was directed to surrender before the Jail Authority on 26.05.2025 before 05:00 PM. 4. Learned Public Prosecutor submits that in pursuance of order dated 25.04.2025, petitioner has not surrendered before the Jail Authority and as such he has misused the liberty of interim bail granted to him by this court. 5. Having regard to the totality of the facts and circumstances of the case and considering the arguments advanced at bar, especially considering the evidence available on record against the petitioner, as also considering the fact that petitioner received huge amount of money from the complainant and he has misused the liberty of interim bail granted by this court vide order dated 25.04.2025 thus, looking to the nature and gravity of offence, I do not find it a fit case to enlarge the petitioner on bail. 6. Accordingly, this second bail application is dismissed. 7. Investigating Officer of this case is directed to take necessary steps to bring the petitioner into custody.
