Mr. Ankur Sharma, Advocate for the applicant. 2. Mr. S.C. Dumka, A.G.A. with Ms. S.B. Dobhal, B.H. for the State. 3. This is the second bail application moved by the applicant. The first bail application of the applicant was rejected vide order dated 06.02.2024. 4. The applicant-Sunny Kumar was incarcerated in connection with FIR No.0002 of 2023 dated 15.02.2023, lodged against unknown persons, under Sections 120-B and 420 IPC and 66D of Information Technology (Amendments) Act, 2008. 5. Learned counsel for applicant submitted that the applicant has been arrested on the basis of disclosure of co-accused; the CCTV footage clearly showed that the amount was withdrawn by Suraj Kumar Verma and the applicant has no role in it. Now there is no chance of tampering with the evidence since the charge sheet has been submitted in the matter. 6. On the other hand, learned State counsel vehemently opposed the bail application of the accused. 7. It is stated in the counter affidavit filed by the State that the role of the applicant was to facilitate the crime by receiving money received in his bank account for which the evidence is yet to be adduced; total three prosecution witnesses have been examined and evidence of remaining witnesses is also underway. Moreover there is no new ground for grant of second bail. 2 8. Having heard learned counsel for the parties, this Court is of the view that no new ground has either been argued or averred in the second bail application. The grounds raised in the present second bail application have already been discussed in the first bail application rejected by this Court on 06.02.2024. 9. Accordingly the second bail application is rejected; however the trial court is directed to expedite the proceedings of the trial and to conclude it within a period of three months from the date of production of certified copy of this order.
