Sanjeev Kumar Mishra"arising out of FIR No. 0362 of 2023 under Section 376 and 406 IPC Police Station Krishna Nagar, District Lucknow pending in the Court of Special Chief Judicial Magistrate (Custom), Lucknow. ii) To quash impugned chargesheet no. 1, dated 10.11.2023 filed under Section 376 and 406 IPC, PS Krishna Nagar, , District Lucknow contained as Annexure no. 1 to this application. iii) To quash impugned cognizance and summoning order dated 20.11.2023 passed in Case No. 124419 of 2023 " State Vs. Sanjeev Kumar Mishra arising out of FIR No. 0362 of 2023 under Section 376 and 406 IPC PS Krishna Nagar, District Lucknow pending in the Court of Special Chief Judicial Magistrate (Custom) contained as Annexure no. 2 to this application. " After arguing at some length, learned counsel for the applicant has submitted that the applicant does not want to press the present case as such, it may be dismissed as not pressed with liberty to move a discharge application before the Court concerned. As such, the present application is dismissed as not pressed with liberty to the applicant to move discharge application before the court concerned. If any such application is preferred, the Court concerned shall decide it expeditiously, in accordance with law, if there is no any other legal impediment.
