1. Heard Sri Raj Vikram Singh, learned counsel for petitioner as well as learned Standing Counsel for respondents.
2. By means of present writ petition, the petitioner has challenged the order dated 01.10.2024 passed by the State Government thereby upholding the punishment order dated 22.08.2019 imposed upon the petitioner.
3. Learned Standing Counsel has raised a preliminary objection stating that petitioner has efficacious remedy before the U.P. Public Service Tribunal and accordingly the petitioner should be relegated for filing a claim petition before the U.P. Public Service Tribunal.
4. Considering the aforesaid facts, it is noticed that petitioner is a government servant and his claim is maintainable before the U.P. Public Service Tribunal against the impugned order of punishment as well as rejection of review against the said order, this Court does not find any ground for exercising extra ordinary power under Article 226/227 of Constitution of India for direction considering that the petitioner has efficacious remedy before the U.P. Public Service Tribunal for redressal of his grievances, the writ petition is dismissed. (Alok Mathur, J.)
