3. By means of this writ petition, petitioners have sought the following relief:-
“iii. Issue a writ, rule or direction in nature of certiorari to quash the 12.09.2023 passed by Presiding Officer Labour Court / Industrial Tribunal Haldwani, District Nainital in Misc. Case No. 03/2023 “Girish Chandra Joshi and others vs. P.O. Labour Court and another” (contained as Annexure No. 1 to the writ petition) along with its effect and operation also, after calling the entire record, or to mould the relief appropriately.
iv. issue a writ, rule or direction in the nature of mandamus directing to the respondents to pay the salary and other dues to the petitioners from the month of October, 2022 to till date.”
4. After arguing for a while, Mr. D.S. Mehta, learned counsel for petitioner submits that he may be permitted to withdraw the writ petition with liberty to petitioners to approach the appropriate forum, including the one under Payment of Wages Act.
5. The writ petition is, accordingly, dismissed as withdrawn with the liberty as above. The order impugned in this writ petition will not come in the way of petitioners, if they approach appropriate forum.
