Petitioner took admission in diploma course in Electronics and Communication Engineering during academic session 2016-17 He was declared unsuccessful in two subjects in the third year examination, held in 2019 and he was denied permission to appear in those back papers in 2023, therefore, he filed this writ petition, seeking the following relief: “Issue a writ order or direction in the nature of mandamus directing the respondents to permit the petitioner to appear in all remaining back papers of polytechnic course.” 3. Learned counsel for Uttarakhand Board of Technical Education submits that as per the Rules, petitioner cannot be permitted to appear in back papers after gap of three years. 4. Since the prayer sought by petitioner is against the rules, applicable in the examining body, therefore, the relief as claimed cannot be granted. 5. The writ petition fails and is dismissed. 6. Pending application(s), if any, stand disposed of.
