JUSTICE MRIDUL KUMAR KALITA ORDER 10.06.2025 1. Heard Ms. D.Bongshiary, the learned counsel appearing on behalf of Mr. S.C. Das, the learned counsel for the petitioner, who submits that Page No.# 2/3 the petitioner was granted interim bail by this Court, by order dated 20.05.2025, and in pursuant to the directions of this Court, the petitioner, namely, Sri Pulen Das has appeared before the Investigating Officer and has co-operated in the investigation. 2. The learned Additional Public Prosecutor appearing for the State of Assam, has produced the Case Diary of Boko P.S. Case No. 50/2025 and has opposed the granting of interim bail absolute on the ground that though the petitioner has appeared before the Investigating Officer and his statement has been recorded, however, there are sufficient incriminating materials against the petitioner in the Case Diary. He also submits that the injury report of the victim shows that the victim sustained grievous injury on the vital parts of the body caused by sharp weapon. 3. I have considered the submissions made by the learned counsel for both sides. Though there are incriminating materials against the petitioner in the Case Diary, however, as the petitioner has complied with the directions of this Court, and as the investigation has fairly progressed, this Court is of the considered opinion that if the petitioner continues to co-operate in the investigation, his custodial detention may not be necessary for fair completion of the investigation of Boko P.S. Case No. 50/2025. 4. In view of the above, the interim bail granted to the petitioner, by order dated 20.05.2025, is hereby made absolute, with condition Nos. (i) and (ii) attached to the said order remaining intact. 5. Send back the Case Diary. Page No.# 3/3 6. With the above observations, this anticipatory bail application is accordingly disposed of.
