1. Heard Shri Gaurav Mehrotra, learned counsel for the petitioner, Ms. Akansha Dubey, learned counsel for the opposite parties and Shri S.B. Pandey, learned Senior Counsel and Deputy Solicitor General of India assisted by Shri Varun Pandey, learned counsel for the Union of India.
3. After hearing the learned counsel for the parties and perusing the original records including the various joint inspection notes and the inspection reports dated 31.01.2023, 21.09.2024, 05.10.2024, 08.10.2024, the show cause notice dated 23.09.2024, the reply of the petitioner dated 14.10.2024 and the final order dated 19.02.2025 by which it has been debarred, what is apparent is that after submission of the show cause notice a detailed reply has been submitted by the petitioner offering its explanation in this regard, but, in the impugned order there is absolutely no consideration of the said reply which was the minimum that was required in compliance of principles of natural justice, therefore, without going any further into the merits of the issues involved, on this ground itself the impugned order is liable to be quashed. It is, accordingly, quashed with liberty to the competent authority to pass a fresh order after considering relevant pleas contained in the reply dated 14.10.2024 and if necessary getting the matter inquired and personal hearing may also be given to the petitioner/ its authorized representative.
