Hon'ble Rajeev Singh,J. Pursuant to the order passed by this Court, Sri Indrajeet Singh, Municipal Commissioner, Nagar Nigam, Lucknow is present in person. Officer present in person has fairly stated that notices issued by the Zonal Officer, Zone - 7, Indira Nagar, Lucknow, while proceeding with the issuance of notice has failed to provide 30 days notice period which has wrongly been restricted to 7 days only. This apparent error requires correction. Officer has also stated that notice under challenge shall be withdrawn forthwith so that matters for cancellation of Vending Zone - 7, Indira Nagar, Lucknow and relocation of all the vendors operating therein is streamlined within a period of two months from today. It is also informed that Town Vending Committee is already functional and all the necessary measures shall be taken by following due process under the law and as per the scheme applicable in this behalf. Once the notice impugned is proposed to be withdrawn by the Officer present in person, no grievance at this stage survives for any redressal in these proceedings, therefore, the writ petition has has lost its efficacy and same is disposed of. It is expected that petitioners or other vendors granted certificates upon cancellation of vending zone shall be accommodated as per the norms applicable and until then they would remain undisturbed.
