In view of the proposed order being passed, notices to respondents No.2 and 3 is dispensed with. Heard learned counsel for the revisionist and learned A.G.A. for the State-respondent. This revision has been filed against the judgment and order dated 21.11.2024 passed by Principal Judge, Family Court, Barabanki in Suit No.748/2020 filed by opposite party No.2 under Section 125 Cr.P.C. Perused the record. It is not in dispute that the respondent No.2 is the legally wedded wife of the revisionist and the respondent No.3 is his minor son. Both are destitute and unable to maintain themselves. They have been neglected and no care of respondent Nos.2 and 3 has been taken by the revisionist. Revisionist has clearly failed to maintain them. On the other hand, revisionist is a healthy person and is capable of maintaining them. Respondent No.2 is residing away for sufficient cause, there is no illegality in the order impugned. Accordingly, the revision being devoid of merits is dismissed.
