The learned counsel appearing for the petitioner is right in his contention that the petition-mentioned lands were originally classified as Vandiyur tank and water catchment area. We have recently held that even in a water catchment area, no construction activities can be permitted. But we are not able to grant any direction in this writ petition for the simple reason that the reclassification had taken place some 44 years ago. The revenue records have been produced before us. As early as on 1981, old survey Nos.137/1, 140 and 141 were reclassified as fertilizer yard for Madurai Corporation. We are not in a position to restrain the authorities from proceeding further. This writ petition stands dismissed. No costs. Consequently, connected miscellaneous petition is closed.
