Baloo is present before this Court physically and similarly, learned counsel for the respondent, Mr. Sanjoy Yambem is also present before this Court physically. The present miscellaneous proceeding in MC(MAC APP) No. 7 of 2025 has been initiated by the applicants and whereby seeking for allowing to withdraw 50% of the total amount of compensation awarded by the Motor Accident Claims Tribunal in MAC Case No. 93 of 2022 dated 08.12.2023. Learned counsel for the applicants is submitting to consider the reasons stated in the application for allowing withdrawal of the amount. Whereas, the learned counsel for the respondent is fairly submitting that the application may be considered. Keeping in view of the submission made by the applicants and also keeping in view of the submission made by the learned counsel for the respondent, it is deemed appropriate to pass an order that the application filed by applicant is permitted to withdraw 50% of the deposited amount with accrued interest. But, in this withdrawal proceeding is concerned, it is ordered that 50% of the deposited amount with accrued interest and the amount shall be released in favour of the applicants and if the claimant being a minor, the share in the compensation award amount, that shall be maintained in Fixed Deposit (FD) in any Nationalised Bank until further order. Consequently, the proceeding for withdrawal for allowing and permitted to withdraw the amount as sought for accordingly ordered. CHIEF JUSTICE Bipin
