This is the second bail application filed under Section 483 of the BNSS for grant of regular bail to the applicant who has been arrested in connection with Crime No. 511/2024 registered at Police Station Sarkanda, District Bilaspur (C.G.) for the offence punishable under Sections 21, 22 of the NDPS Act. 2. Case of the prosecution, in brief, is that allegedly the accused RAHUL DEWANGAN Digitally signed by RAHUL DEWANGAN
2 illegally kept 20 pieces of banned intoxicant Codeine Phosphate and Tripolidine Hydrochloride syrup ONEREX inside a cartoon in the trunk of his scooter number CG-10/BJ/8138. The accused was asked to present the relevant documents regarding the possession of aforementioned contraband and on failing to do so, he was arrested. Thereafter, the case has been registered against the applicant. 3. Learned counsel for the applicant submits that the first bail application was rejected vide order dated 28.06.2024 on merits on the ground that contraband article seized from the applicant was much above the commercial quantity, with the direction, to the trial Court to conclude the trial within a period of six months, if there is no legal impediment. However, till date, the trial is yet not been concluded the further, the applicant is languishing in jail since
05.05.2024. He lastly submits that out of total 13 witnesses, 09 witnesses have been examined till date, 02 witnesses have given up and 02 witnesses are yet to be examined, hence this second bail application for grant of bail to the applicant. 4. Learned State counsel on the other hand opposes the bail application of the applicant and submits that from the possession of the applicant, the quantity of contraband article recovered was much above the commercial quantity, and further pendency of trial cannot be a ground for grant of bail to the applicant. 5.
From perusal of the records, it transpires that this is the second bail application of the applicant and first bail application of the
3 applicants was rejected by this Court vide order dated 28.06.2024 in MCRC No. 4079 of 2024 on the ground that the contraband article seized from the possession of the applicant was much above the commercial quantity, further no new ground has been raised in this second bail application. 6. This Court does not find any merit in this second bail application of the applicant- Vikram Singh filed under Section 483 of the BNSS for grant of regular bail to the applicant who has been arrested in connection with Crime No. 511/2024 registered at Police Station Sarkanda, District Bilaspur (C.G.) for the offence punishable under Sections 21, 22 of the NDPS Act, as such, the same stands rejected at this stage. 7. No new ground has been raised in this second bail application. More so, as the time period of six months granted to the learned trial Court from 28.06.2024 has expired, in such circumstances, the trial Court is granted further period of three months to conclude the trial, if there is no legal impediment. 8. OfÏce is directed to provide a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. -
