This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…pleased to issue a writ or order more particularly one in the nature writ of mandamus or an appropriate writ or order declaring the action of the 3rd and 4th Respondents are not investigating the Hanging case U/s 174 Cr.P.C and closing the case at M.E.Magistrate Level without taking the custody of 5th and 6th Respondents which is a fit case U/s 306 IPC and Consequently direct the 2nd respondent to change the Investigation officer to conduct the investigation at fresh with the help of listed witness of family members of deceased and other independent listed witness..…”
2. None represented for the petitioner. 3. It is a case where, the petitioner is challenging the police for closing the case which is registered under Section 174 of Cr.P.C., though there is material to register a case under Section 306 of IPC. 4. Sri V.Farooq, learned Assistant Government Pleader for Home on instructions, would submit that since, there is no material to register a case under Section 306 of IPC, the case was closed by the police. 5. Recording the same, the Writ Petition is disposed of. However, the petitioner is at liberty to work out her remedies before the appropriate forum. There shall be no order as to costs. 4
