1. At the outset, learned counsel for the applicant submits that the Judicial Magistrate First Class had convicted respondent No.2 (husband of the PRIYANKA VERMA Digitally signed by PRIYANKA VERMA Date: 2025.08.05 10:30:28 +0530
2 applicant) under Section 498-A of the IPC. However, respondent No.2/accused was acquitted of the said charge by the impugned
judgment dated 06.02.2024. He would further submit that against the said judgment, right to appeal under Section 372 of the CrPC (New Section 413 of the Bharatiya Nagarik Suraksha Sanhita, 2023) is available in respect of the wife, who is also the victim. Therefore,
learned counsel for the applicant seeks permission of this Court to withdraw this Revision with liberty to file a better petition in accordance with law.
2. Learned counsel for the other side would not oppose the said prayer.
3. In view of the aforesaid submission, this Revision is dismissed as withdrawn with the aforesaid liberty granted to the applicant.
