For the Respondents: Mr. Anup Rattan, Advocate General with Mr. Rajan Kahol, Mr. Vishal Panwar and Mr. B.C.Verma, Additional Advocate Generals and Mr. Ravi Chauhan, Deputy Advocate General, for the respondents/State. ____________________________________________________ Sandeep Sharma, Judge(oral): Since, it is quite apparent from impugned transfer order dated 23.04.2025, whereby petitioner herein, who is working as JOA(IT) in the office of Sub Divisional Officer(C), Rampur, District Shimla, Himachal Pradesh, has been ordered to be transferred to the office Sub Divisional Officer(C), Kumarsain, District Shimla, Himachal Pradesh vice Sh. Subhash, respondent No.4 has already completed his normal tenure of posting at present place of posting, this Court sees no reason to interfere in the impugned transfer order and as such, same is upheld. 1Whether the reporters of the local papers may be allowed to see the judgment? 2 2. However, having taken note of adverse family circumstances, as came to be apprised to this Court by learned counsel for the petitioner during proceedings of the case, this Court without going into the merits of the case, deems it fit to dispose of the present petition with liberty reserved to the petitioner to file representation to the competent authority within a period of one week, praying therein for cancellation of transfer order or his adjustment at convenient station on account of adverse family circumstances, which in turn, shall be decided by the competent authority within a period of one week. Ordered accordingly. Needless to say, authority concerned, while doing the needful in terms of instant order, shall afford an opportunity of hearing to the petitioner and pass detailed speaking order thereupon, taking note of the transfer policy. Till the time, representation, if any, filed by the petitioner within a period of one week is not decided by the competent authority, petitioner shall not be compelled to join at the transferred station in terms impugned transfer order, if not already relieved.
