Neutral Citation No. - 2025:AHC-LKO:13205 Court No. - 8 Case :- WRIT - C No. - 2088 of 2025 Petitioner :- Mishrilal Respondent :- State Of U.P. Thru. Prin. Secy. Deptt. Of Revenue, Lko. And Others Counsel for Petitioner :- Prabhakar Srivastava,Ashish Kumar Counsel for Respondent :- C.S.C. Hon'ble Jaspreet Singh,J. Heard learned counsel for the petitioner. Notice on behalf of respondent nos.1, 2 and 3 has been accepted by the office of Chief Standing counsel. The petitioners prays for quashing of the order dated 30.06.2023 passed by the respondent no.3 in computerized Case No. T20161033052650, Case No. RST/2650/2016, under Section 35 of U.P. Revenue Code-2006: Mishrilal Vs. Khemkaran. Learned counsel for the petitioner, after arguing at some length, could not dispute the fact that against the impugned order dated 30.06.2023, the petitioner has remedy in terms of U.P. Revenue Code-2006. Accordingly, in view of the availability of statutory remedy, this Court is not inclined to entertain the petition leaving it open for the petitioner to take recourse against the impugned order, as may be available to him in accordance with law. It is made clear that the Court has not examined the case of either of the parties on merits and the authority concerned shall be free to decide the matter strictly in accordance with law. The petition is dismissed solely on the ground of availability of statutory remedy available to the petitioner.
