Impugning letter No.SE/Civil (O & M)C/SLR/D.No.766/2025 dated 04.03.2025, issued by respondent No.3, awarding contract works in pursuance of tender notices S200011110/SE/Civil/O&M/495/25-26 and S200011109/SE/Civil/O&M/495/25-26, dated 12.02.2025, in favour of prospective bidders, the above writ petition, is filed. 3. At the hearing the learned counsel for the petitioners submitted that respondent No.3 is awarding tender in favour of prospective bidders, in violation of tender conditions 11 and 12. Learned standing counsel, produced a copy of the instructions furnished by the Superintending Engineer and submitted that since the bidders have quoted at abnormally low rates, the authority intends to cancel the aforementioned tender and call for fresh tenders as per the requirement. 5. The relevant part of the instructions is extracted hereunder: “It is to inform that for the subject work under No.1, Ten (10) Nos. tenderers (SC/ST societies and individuals only) have quoted their rates at 76% less by all the bidders and no bids are received by online. One of the bidders (by name Sri. Ch. Syamson, Upper Sileru was selected by lottery) was requested to attend this office for concluding the agreement. It is to inform that for the subject work under No.2, Ten (10) Nos. tenderers (SC/ST societies and individuals only) have quoted their rates at 68% less by all the bidders and no bids are received by online. One of the bidders (by name Sri. A. Seetha Ramulu, Upper Sileru was selected by lottery) was requested to attend this office for concluding the agreement. … It is to submit that since the bidders have quoted their rates at abnormally less, we are under the opinion to cancel the tenders and call for fresh tenders as per the requirement. ” 6. Given the instructions of the Superintending Engineer, since the authority intends to cancel the tenders and go for fresh tenders, no further adjudication is required in this writ petition. 7. Hence, this writ petition is closed. No costs.
