1. The petitioner has filed this writ petition seeking following reliefs:-
“10.1 The Hon’ble Court may kindly be pleased to call for the entire record pertaining to the case of the petitioner. 10.2 The Hon’ble Court may kindly direct the respondent authorities to consider the representation of the petitioner and granted his all service benefits NISHA DUBEY Digitally signed by NISHA DUBEY
Page No.2 from till he is entitled to the received as per Rule 54 of the Fundamental Rules. 10.3 Any other relief, which this Hon’ble Court may deems fit and proper may also be awarded to the petitioner.”

On a question being put to learned counsel for State as to when pension etc. will be paid to the petitioner, she seeks for a pass over to seek instruction in the matter and accordingly, the matter was passed over for second half. In the second half, learned State Counsel, on instructions, submits that the process for grant of pensionary benefit to the petitioner is under process and it is likely to be completed within 45 days. 3. In view of above submission of learned State Counsel, learned counsel for the petitioner prays that this writ petition may be disposed of directing the respondents to consider case of the petitioner for grant of pension at the earliest. 4. Heard learned counsel for both the parties. 5.
Considering the facts and circumstances of the case and submissions of learned counsel for the parties, this writ petition stands disposed of with a direction to the respondent authority concerned to consider and decide the case of petitioner for grant of pension in accordance with law expeditiously, preferably within 30 days. The petitioner will be at liberty to file fresh petition in case pension and other retiral benefits are not paid to him. 6. Certified copy as per rules. Sd/-
