Heard learned counsel for the parties and perused the record. 2. The present petition has been filed by the petitioner challenging an interlocutory order dated 14.05.2024 passed by the State Consumer Disputes Redressal Commission, Lucknow. While entertaining the appeal filed by the appellant, simultaneously notices were issued on the delay condonation application and an order of stay was also passed subject to deposit of entire decretal amount within a period of six weeks. 3. The contention of the counsel for the petitioner is that prior to defend the delay condonation application, the stay application could not have been decided as was held by the Division Bench of this Court in the case of Ram Prakash Vs. Deputy Director of Consolidation, Hardoi and others decided on 03.02.2022. 4. Considering the fact that the impugned order is an interlocutory order and the petitioner has a remedy of moving an application for withdrawing the amount, which was deposited in terms of the directions issued by State Consumer Disputes Redressal Commission, I do not see any reason to interfere in the matter at this stage. The petitioner would be at liberty to move an application for release of the amount before the State Consumer Disputes Redressal Commission, which shall be decided in accordance with law. 5. The petition is disposed of in terms of the above.
