The instant application has been filed seeking following main relief:- "For the facts reasons and circumstances mentioned in the accompanying affidavit it is most respectfully prayed, that this Hon'ble court may kindly be pleased to set aside the impugned proceeding of Under Section 84, of B.N.S.S. as well as entire proceedings initiated against the applicant by the Learned Chief Judicial Magistrate, Ambedkar Nagar, arising out in case crime no.0365 of 2024, Under Section 191 (2), 109, 352 & 351 (3) of BNSS, at Police Station- Tanda, District- Ambedkar Nagar pending in the court of Learned Chief Judicial Magistrate, District- Ambedkar Nagar, (A NNEXURE NO-1)." At the very outset, learned counsel for the applicant prays for withdrawal of this application with liberty to the applicant to file a fresh application with proper pleadings and documents in support thereof. The aforesaid has not been opposed. In view of the above, the instant application is dismissed as withdrawn with liberty, as prayed for. Office is directed to return certified/original copies of the documents annexed with this application to the learned counsel for the applicant as per relevant Rules in this regard.
