The present petition has been filed with the following prayer : "Direct the Additional Civil Judge (Senior Division) not to proceed further in Execution Case No.01/2013 till disposal of application for interim relief pending in the Civil Misc. Appeal No.34 of 2024 before the Learned District Judge Lakhimpur Kheri." 3. The documents on record reveal that the petitioner has preferred a Civil Misc. Appeal no.34 of 2024 in which a stay application was also filed, which is pending as per the order dated 23.12.2024, contained in Annexure no.11. 4. As the petitioner has already moved an application for Stay, I do not deem it appropriate to pass any orders, as prayed. 5. As the petitioner has already availed the remedy of interim prayer in the appeal preferred, the present writ petition is dismissed.
