The present application has been filed for the following main relief:- "Wherefore, it is most respectfully prayed that this Hon'ble Court may kindly be pleased to quash the entire proceedings of Misc. Case No. 377 of 2024; (Ram Naresh Vs. State), arising out of First Information Report No. 575 of 2023 under Section 302, 201 I.P.C., Police Station Sandana, District Sitapur as well as summoning order dated 01.08.2024 passed by Learned Chief Judicial Magistrate, Sitapur, so far as it relates to the petitioner, as contained in Annexure No. 1 of this application." After arguing at some length, the learned Counsel for the applicant states that he may be permitted to withdraw the present petition with liberty to file a fresh with proper pleadings, prayer and documents in support thereof including challenging the order dated 16.01.2025 whereby the revisional court affirmed the order of Chief Judicial Magistrate concerned dated 01.08.2024. To the aforesaid prayer, learned A.G.A. has no objection. Accordingly, the present application is dismissed with liberty as aforesaid. Office is directed to return back all the certified copies of order and documents, annexed in the present application, to the learned Counsel for the applicant, if he applies for the and submit the copies of same.
