The present application has been filed for the following main relief:- "WHEREFORE, it is most humbly prayed that this Hon'ble Court may kindly be pleased to quash the impugned Charge Sheet (Police Report) bearing No. 91 of 2002, dated 28.07.2002, vide Case Crime No. 121 of 2002, under Section 363, 366 I.P.C. Police Station Paliya, District Kheri and order of cognizance and summoning order dated 27.08.2002, passed by learned Chief Judicial Magistrate, Kheri in Case No. 6183 of 2002 (Now Case No. 7400 of 2009) vide "State Versus Shyam Prakash and another and further proceedings of the case in pursuance thereof, pending in the court of learned Chief Judicial Magistrate, Kheri, in the ends of justice." After arguing at some length, the learned Counsel for the applicant states that he may be permitted to withdraw the present petition with liberty to file a fresh with proper pleadings and documents in support thereof. To the aforesaid prayer, learned A.G.A. has no objection. Accordingly, the present application is dismissed with liberty as aforesaid. Office is directed to return back all the certified copies of order and documents, annexed in the present application, to the learned Counsel for the applicant, if he applies for the and submit the copies of same.
